1. About these terms

These Terms of Service govern your use of phangandev.com and any freelance services provided by Phangan Dev, a sole-trader studio based on Koh Phangan, Surat Thani, Thailand.

By using this website or engaging our services, you agree to these terms. If you do not agree, please do not use the site or engage our services.

2. Services

Phangan Dev provides freelance web development services including but not limited to:

• Website design and development
• Custom web application development
• Desktop application development
• Database design and optimisation
• SEO and technical audits

The scope, deliverables, timeline, and payment terms for any project are defined in a separate written agreement or proposal provided before work begins.

3. Payments

All projects require a deposit before work begins. The deposit amount and payment schedule will be outlined in your project proposal. Invoices are due within the timeframe stated on the invoice. Late payment may result in work being paused until the outstanding balance is settled.

All prices are quoted in USD unless otherwise agreed. We accept bank transfer and other payment methods agreed upon in writing.

4. Intellectual property

Upon receipt of full payment, all custom code and assets created specifically for your project transfer to you. Phangan Dev retains the right to display the completed work in its portfolio unless you request otherwise in writing prior to project start.

Third-party libraries, frameworks, and components used in your project are subject to their respective open-source licences. Phangan Dev does not transfer ownership of any third-party software.

5. Revisions and scope

Each project includes a defined number of revision rounds as stated in your proposal. Work outside the agreed scope will be quoted separately. Changes that fundamentally alter the project brief may require a new agreement.

6. Client responsibilities

You agree to:

• Provide timely feedback and approvals to keep the project on schedule
• Supply any required content, credentials, or access within an agreed timeframe
• Ensure you have the right to use any materials (text, images, logos) you provide to us
• Not use delivered work for unlawful purposes

7. Warranties and limitations

We build with care, but software is complex. We do not warrant that the work delivered will be entirely free of bugs or that it will meet every requirement not explicitly stated in the agreed scope.

To the maximum extent permitted by law, Phangan Dev's liability for any claim arising from services rendered is limited to the total fees paid for the specific project in question. We are not liable for indirect, incidental, or consequential damages.

8. Cancellations

Either party may cancel a project with written notice. If you cancel after work has begun, you are liable for payment of work completed up to the cancellation date, based on the agreed project rate. Deposits are non-refundable once work has started.

9. Confidentiality

We treat all client information as confidential and will not disclose project details, business data, or credentials to third parties without your consent, except where required by law.

10. Website use

You may use this website for lawful purposes only. You must not attempt to probe, scan, or test the vulnerability of the site, or circumvent any security measures in place.

11. Governing law

These terms are governed by the laws of Thailand. Any disputes will be resolved through good-faith negotiation in the first instance. If that fails, disputes will be subject to the jurisdiction of the courts of Surat Thani Province, Thailand.

12. Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top of this page will reflect any changes. Continued use of the website after changes constitutes acceptance of the updated terms.
